1-Bookings

A binding contract comes into existence as soon as we receive the dated offer, signed with the mention "Agreed and Approved". It is your responsibility to check the details of the offer we send you and to contact us if any information on the quote or any other document appears to be inaccurate or incomplete. In case of special requests, you must notify us in writing at the time of booking.

You agree that the Organizer will deal with us on your behalf. In case of a change of organizer: you must inform us immediately in writing (Email).

2-Payments

We will invoice you after the event based on the number of participants communicated by phone and confirmed by email ten working days before the event date. In case of absent persons on the day of the event, we will not deduct this amount from the final invoice. The total invoice must be paid no later than 30 days after receipt.

If the deadline exceeds 30 days, you must inform us in writing, specifying the payment terms customary in your company.

Payments must be made by bank or postal transfer according to the bank details mentioned on the invoice.

You may be asked to pay a deposit of 30% to 50% of the service amount, depending on the type of order.

3-Special Requests

In case of special requests, you must notify us in writing (email) at the time of booking.
Although we endeavor to forward all reasonable requests to the relevant service provider, we cannot guarantee that any request will be met, unless we have expressly confirmed it in writing.
If your special request occurs after your booking, additional charges may apply.

4-Pricing Policy

The prices of the services sold are those in effect on the day the quote is sent, denominated in CHF, excluding VAT.

Upon receipt of the signed offer, the unit or package price of the chosen service will remain unchanged unless there is a late special request.

For activities, the final number of participants must be communicated to us no later than ten days before the event date in writing (email). Invoicing will be based on the number confirmed at that time.

The minimum invoicing amount for our services is CHF 1,500.00 excluding VAT (excluding travel expenses).

5-Description of Activities on the Site

All descriptions on the website are made in good faith and all precautions are taken to ensure their accuracy.
However, errors may occur. FunProd accepts no responsibility for any errors or omissions.
FunProd reserves the right to make changes and correct errors in our descriptions on the website at any time.

6-Modification and Cancellation by FunProd

We reserve the right to modify or cancel bookings, exceptionally.
In case of significant changes or cancellation of the service, we will inform you as soon as possible and offer you the choice between the following options:
– Accept the proposed changes
– Opt for an alternative activity of a similar amount to the initial service. Any price fluctuation will need to be paid or will be refunded to you.
– Accept the cancellation. In this case, you will receive a full and prompt refund of the amounts paid.

These options above are only applicable for significant changes or cancellations resulting from FunProd's decision.
In cases of force majeure or just cause, no refund can be demanded. Force majeure is an external, unforeseeable, and irresistible event. Just cause is a circumstance which, according to the rules of good faith, does not allow requiring the party who gave notice to continue the working relationship.

7-Modifications and Cancellations by the Client

In case of a booking modification, FunProd Sàrl will try to accommodate your request as much as possible. However, FunProd cannot guarantee that changes will always be possible. If it is possible to modify the booking, there will be no modification fees, but any additional costs incurred will be charged. If you wish to cancel all or part of your booking, you must inform us immediately in writing (email) and the following fees will apply according to the withdrawal period:

• Between 30 and 10 days: 50% of the total amount will be due
• Less than 10 days: 100% of the total amount will be due
• No-show at the Service location: 100% of the total amount will be due

8-Weather Conditions

FunProd has no control over weather and climatic conditions. They are therefore not part of the contractual obligations. If, due to bad weather conditions, you are unable to take part in your activities, we cannot be held responsible in any way.

We can help you find alternative activities or arrangements, but these may incur additional costs at your expense.

In case of modification or cancellation by the Client, you will not be entitled to any refund (see article 7).
You will not be entitled to the options and/or compensations provided in article 6 above.

In case of modification or cancellation by FunProd (and third-party companies), we will contact you as soon as possible and make every effort to find an alternative solution (backup), or change the event date.

9-Responsibility and Safety

FunProd cannot be held responsible for any damage to the client whose origin is beyond its control.

FunProd disclaims responsibility for services provided by third-party companies. Except in cases of negligence or gross misconduct, FunProd's potential liability cannot lead to compensation exceeding the sum paid by the Client for the services provided under this contract.

We cannot guarantee absolute safety against objective dangers. The Client agrees to assume the remaining risk of a leisure activity that cannot be avoided despite careful preparation and prudent conduct.

As part of the personal responsibility incumbent on the client and to ensure the safest possible execution, the client must follow the Service Provider's instructions and inform them of any concerns as well as any physical and/or psychological problems.

10-Insurance

FunProd is covered by professional liability insurance. However, the Client must have health and accident insurance. Furthermore, cancellation insurance is recommended.

11-Service Providers' General Terms and Conditions

Some of the Services offered on the Site are provided by independent Service Providers of FunProd.
These Service Providers provide these services in accordance with their own General Terms and Conditions of Sale.
A copy of these General Terms and Conditions of Sale is available upon request.

12-Health and Physical Conditions

Several activities are not recommended for people with disabilities, illnesses, infirmities, or who are pregnant.

If any Participant has a medical condition, allergy, or disability, you must inform FunProd before making your booking.
If we deem that the chosen activity is not suitable for these individuals,

13-Confidentiality

We undertake not to disclose information communicated to us by the Client and expressly stipulated as confidential in our Privacy Policy.

14-Competent Jurisdiction

Any dispute that may arise between the parties regarding the formation, execution, or interpretation of these general conditions shall be under the exclusive jurisdiction of the Commercial Court of the Canton of Geneva.
